This Acceptable Use Policy ("AUP") sets out what you may and may not do with Ficka Mail. It applies to every account, is part of our Terms of Service, and may be updated from time to time. Violations may result in immediate suspension or termination.
1. Email sending rules
Ficka Mail is a permission-based email marketing platform. To send email through the Service, you must have a lawful basis to contact every recipient on your list. Specifically:
- Consent. Recipients must have explicitly opted in to receive email from the sender at the address being used, or the sender must have another lawful basis under applicable law (e.g. an existing business relationship within the last 24 months where permitted).
- Identification. Every marketing message must clearly identify the sender and include a valid physical postal address.
- Unsubscribe. Every marketing message must include a clear, functional way to unsubscribe. You must honor unsubscribe requests within 10 business days and not attempt to re-subscribe the recipient without fresh consent.
- No deception. Subject lines, from addresses and content must not be misleading.
- Local law. You must comply with all applicable anti-spam and data protection laws, including the US CAN-SPAM Act, the EU ePrivacy Directive and GDPR, Canada's CASL, the UK PECR, and equivalent legislation in the jurisdictions of your recipients.
2. Prohibited list sources
You may not use the Service with lists that have been:
- Purchased, rented, scraped, harvested, or obtained from any third party without verifiable, specific consent;
- Collected via contests, giveaways, or co-registration forms that did not clearly disclose who would be emailing them;
- Built from public directories (e.g. WHOIS, LinkedIn scraping);
- Reactivated after long periods of inactivity without fresh consent.
3. Prohibited content
You may not use the Service to create, send, host or distribute content that:
- Is unlawful, fraudulent, deceptive, defamatory, obscene, or invasive of another's privacy;
- Promotes or facilitates phishing, pharming, malware, spyware, or unauthorized access to systems;
- Infringes third-party intellectual property or publicity rights;
- Promotes hate speech, harassment, or incites violence;
- Advertises products or services in the following categories without prior written approval from us: escort services, pornography, pharmaceuticals, cryptocurrencies or tokens of unverified provenance, multi-level marketing, "get rich quick" schemes, pump-and-dump stock tips, work-from-home scams, gambling in jurisdictions where prohibited, and illegal drugs.
4. Technical abuse
You may not:
- Attempt to probe, scan, or test the vulnerability of the Service without our prior written permission;
- Bypass, disable, or circumvent any security, throttling, or authentication mechanism;
- Interfere with or disrupt the integrity or performance of the Service;
- Use automated means to overload the API, admin UI, or any other interface;
- Resell access to the Service without authorization (self-hosted multi-tenant operators are expressly permitted by our Terms);
- Use the Service to send email that originates from infrastructure associated with botnets, open relays, or other compromised hosts.
5. Deliverability & reputation
Protecting sender reputation is a shared responsibility. To stay in good standing:
- Maintain a bounce rate below 5%, a complaint rate below 0.3%, and an unsubscribe rate within industry norms;
- Use verified domains with SPF and DKIM (and where possible DMARC) correctly configured;
- Clean your lists regularly, including segmenting inactive recipients and removing role-based addresses where appropriate;
- Warm up new sending domains and IPs gradually rather than blasting at full volume on day one.
We reserve the right to throttle, pause, or suspend sending when metrics indicate a deliverability or abuse risk.
6. Reporting abuse
If you believe someone is using the Service in violation of this AUP, please report it to abuse@fickamail.com with as much detail as possible (headers, sending address, timestamps).
7. Enforcement
We investigate reported violations in good faith. Depending on severity and context, we may:
- Issue a warning and request remediation;
- Throttle or pause sending on the account;
- Suspend the account pending investigation;
- Terminate the account and retain records as required for legal or security reasons.
Repeated, deliberate, or severe violations will result in permanent termination.
8. Changes
Email abuse and the law evolve. We may update this AUP at any time; material changes will be announced via the Service.
